A Notice of Proposed Regulatory Action was published in the California Regulatory Notice Register (File Number Z-2019-1022-06) on November 1, 2019. The 45-day comment period commenced on November 1, 2019 and closed on December 17, 2019. CalPERS received one public comment during this period. After additional analysis of statutory requirements and future program costs, CalPERS has opted to revise the proposed regulations.

CalPERS has made the following changes to the proposed regulation:

  • Added language in Section 592.1(a) to specify that the fees collected will be deposited into the Old Age and Survivors’ Insurance Revolving Fund (OASI Fund).
  • Removed language in Sections 592.1(d)-592.1(d)(2) regarding the methodology for calculating the fee adjustment by using fluctuations in the Consumer Price Index for All Urban Consumers: U.S. City Average (CPI-U).
  • Added language in Sections 592.1(d)-592.1(d)(4) to establish a revised method to calculate the fee adjustment that includes annually reviewing the OASI Fund. If the fund balance is less than 50 percent or greater than 100 percent of one year’s budgeted SSSA program expenditures, the fees established in Section 592.1(c)(3) will be adjusted to target a fund balance of 50 percent of budgeted SSSA program expenditures.

In addition, CalPERS is providing an Addendum to the Initial Statement of Reasons to explain the purpose and necessity for the changes.

Pursuant to the requirements of subdivision (c) of section 11346.8 of the Government Code and section 44 of Article 2 of Chapter 1 of Division 1 of Title 1 of the California Code of Regulations, the California Public Employees' Retirement System (CalPERS) hereby provides notice of changes it has made to its proposed regulation, titled "Significant Increase in Actuarial Liability Due to Increased Compensation Paid to a Non-Represented Employee," adding section 579.9 to Article 6 of Chapter 2 of Division 1 of Title 2 of the California Code of Regulations.

The 45-day comment period commenced on February 16, 2018 and closed on April 2, 2018. CalPERS did not receive any public comments during the public comment period. The proposed regulation was submitted to the Office of Administrative Law for review on October 11, 2018. Due to the need to revise the proposed regulation for clarity, CalPERS withdrew the proposed regulation on November 26, 2018.

The regulation was submitted to the Office of Administrative Law for review on May 20, 2021. Due to the need to revise the proposed regulatory text for clarity, CalPERS has opted to modify the proposed regulations.

CalPERS has made the following changes to the proposed regulation:

  • Deleted language in section 599.500(a)(8)(A) requiring that the risk assessment method selected by CalPERS be consistent with industry best practices and reinserted the original regulatory language that the risk adjustment methodology selected by CalPERS be consistent with industry best practices and similar to risk adjustment methodologies used by the U.S. Department of Health and Human Services and other state and federal agencies. The reinsertion is now in section 599.508(a)(8).
  • Reinserted in section 599.508(a)(8) the original regulatory language requiring CalPERS to provide health benefit plans its risk adjustment methodology at least 90 days prior to the public announcement of the following year health benefit plan premiums.
  • Deleted the provision in section 599.508(a)(8)(B) permitting the CalPERS Board to exclude certain health benefit plans from having their premiums risk adjusted.
  • Clarified and added criteria to the provision in section 599.508(a)(8)(C) permitting the Board to phase-in a risk adjustment calculation to all or specific health benefit plans over a period as determined by the Board. Due to other deletions, this revised provision is now in section 599.508(a)(8)(B).
  • Specified in section 599.508(a)(8)(D) that risk adjustment does not apply to CalPERS Medicare health benefit plans. Due to other deletions, this revised provision is now in section 599.508(a)(8)(C).

  • Amended language in section 599.500(o), subparagraph (1)(C) to clarify the school or college record documentation required to certify financial dependency, add “other verifiable documents showing common residency” as one of the primary Parent-Child Relationship documents, adjust the listing order of the required primary supporting Parent-Child Relationship documentation, and add the word “Current” to 2. and 3. to clarify that the documents must be a current child’s driver license or state identification and a current rental or lease agreement.
  • Amended language in section 599.500(o), subparagraphs (1)(D) to clarify the vehicle registration documentation required to certify financial dependency and placed this requirement in a newly added 4.
  • Added language to section 599.500(o), subparagraph (1)(E) to include an exception that the documents listed in subparagraph (1)(C) 1. through 4. may be older than 60 calendar days from the date of signature of the Affidavit of Parent-Child Relationship.
