Conditions of Use for myCalPERS for Business Partners

Acceptance of Terms

When you log in to our secure services on myCalPERS, you acknowledge and agree to comply with these Conditions of Use, as well as all applicable laws, regulations, and policies governing the management of data you may access through the myCalPERS Employer Portal (e.g., pension data).

Security Policy

To ensure your organization’s information remains confidential, CalPERS has taken several steps designed to safeguard the integrity of our communications and computing infrastructure, including, but not limited to, data encryption, password authentication, security auditing, and vulnerability testing. Despite implementing such industry standards and recommended security measures, it’s impossible to fully guarantee data security, including your organization’s information.
Our website and computer systems are for legal and authorized use only. Unauthorized access, attempted access, or use of this or any related State of California system is a violation of California Penal Code, Section 502 and/or applicable federal law, and may be subject to prosecution. Individuals using this system without authority, or in excess of their authority, are subject to having their activities on the site monitored and recorded beyond our normal monitoring and recording.

Protection of Personal Information

CalPERS implements procedures and technology that are designed to protect your organization’s personal information, including:

  • Physical security and technological means to prevent unauthorized access to your organization’s information. For example, multifactor authentication is used to verify individuals accessing their myCalPERS business partner account.
  • Information security safeguards designed to maintain the security of information databases, applications, networks, and physical records
  • Security audits and vulnerability testing to promptly identify and mitigate security threats

Authorized Access & User Responsibilities

Access to myCalPERS is restricted to authorized users conducting official pension or health related business on behalf of your organization. You acknowledge that you may only conduct official pension or health-related business on behalf of your employer when accessing the myCalPERS Employer Portal. Designated employees are responsible for maintaining the confidentiality of their login credentials and must not share access with unauthorized individuals.

Contact CalPERS at 888CalPERS (or 888-225-7377) if you believe that an unauthorized person has gained access to your username, password, or if you discover unauthorized activity.

Data Security & Confidentiality

You agree to protect the confidentiality of all pension and health related information and to use it solely for legitimate business purposes. Unauthorized access, disclosure, modification, or distribution of pension or health data is strictly prohibited. You must immediately report any suspected unauthorized access, data breach, or security incident to CalPERS by contacting us at infosec_incidents@calpers.ca.gov.

Accuracy & Integrity of Information

Business partners are responsible for ensuring that all information submitted via the myCalPERS Employer Portal is accurate, complete, and up to date. Any errors or discrepancies must be corrected in a timely manner to maintain compliance with pension and health benefits regulations. Providing false, misleading, or fraudulent information may result in access revocation.

Compliance with Laws & Policies

Users must comply with all applicable federal, state, and local laws as well as CalPERS policies related to pension administration, privacy, and data protection. Unauthorized access, attempted access, or use of this or any related State of California system is a violation of California Penal Code, Section 502 and/or applicable federal law, and may be subject to prosecution. Failure to comply with these laws and policies may result in immediate suspension or termination of myCalPERS access.

System Monitoring & Auditing

Use of myCalPERS is monitored and audited to ensure compliance with security and operational policies. Any unauthorized use or violation of Conditions of Use may result in immediate suspension or termination of myCalPERS access.

Prohibited Activities

Users are strictly prohibited from using myCalPERS for any unauthorized, fraudulent, or malicious purposes, attempting to gain unauthorized access to other users’ data or system functionalities, or engaging in any activity that could compromise the security, integrity, or availability of myCalPERS or any data in the myCalPERS Employer Portal.

Consequences of Misuse

Violation of the Conditions of Use may result in immediate suspension or termination of myCalPERS access. Serious violations may be reported to legal or regulatory authorities for further action.

Updates to the Conditions of Use

CalPERS reserves the right to modify these Conditions of Use at any time. Continued use of myCalPERS after changes are made constitutes acceptance of the updated terms.
